Terms of Service

By engaging Infinity Accountants to provide any accounting, tax, bookkeeping, payroll, advisory, or related services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These terms apply to all clients, whether individuals or businesses, and are governed by the laws of New South Wales, Australia.

Infinity Accountants provides a range of accounting and financial services including, but not limited to:

• Individual and business tax return preparation and lodgement. • BAS and GST preparation and lodgement. • Bookkeeping and financial reporting. • Payroll management and Single Touch Payroll (STP) reporting. • SMSF accounting and compliance. • Business advisory and strategic planning. • Company and trust formation and registration.

The specific scope of services provided to you will be agreed upon in a separate engagement letter or service agreement.

To enable us to provide accurate and timely services, you agree to:

• Provide complete, accurate, and up-to-date information and documentation as requested. • Notify us promptly of any material changes to your financial position, business activities, or personal circumstances. • Review and approve work product (e.g., tax returns, financial statements) before lodgement. • Meet payment obligations within the agreed timeframes. • Retain copies of all documents provided to us and submitted to regulatory authorities.

You acknowledge that the quality of our services is dependent on the accuracy of information you provide.

Our fees are as outlined in our service agreements and engagement letters. Unless otherwise agreed:

• Fixed-fee services are payable upon completion or as specified in your engagement letter. • Monthly retainer services are invoiced monthly in advance. • All fees are quoted and payable in Australian Dollars (AUD) and are exclusive of GST unless stated otherwise. • Invoices are due within 14 days of the invoice date.

Late payments may incur interest at a rate of 10% per annum calculated daily. We reserve the right to withhold services and documentation until outstanding fees are settled.

We will notify you before commencing work if the scope expands and additional fees will apply.

We are committed to maintaining the confidentiality of all information you provide. We will not disclose your information to third parties except:

• As required by law or regulatory obligation (e.g., ATO, ASIC). • To sub-contractors or service providers engaged to assist in delivering our services, under strict confidentiality obligations. • With your express written consent.

Infinity Accountants is a registered tax agent with the Tax Practitioners Board (TPB) and our practitioners hold CPA and/or IPA qualifications. We are bound by the Code of Professional Conduct under the Tax Agent Services Act 2009 (Cth) and the professional standards of CPA Australia and the Institute of Public Accountants.

Our services are subject to liability limited by a scheme approved under Professional Standards Legislation.

To the maximum extent permitted by law:

• Our liability for any loss or damage arising from the provision of our services is limited to the fees paid for the specific service giving rise to the claim. • We are not liable for any indirect, incidental, special, or consequential loss or damage, including loss of profits, revenue, or data. • We are not responsible for errors arising from inaccurate or incomplete information provided by you. • ATO decisions, penalties, or interest arising from your own actions or omissions are your responsibility.

Nothing in these terms limits liability that cannot be excluded under Australian Consumer Law.

All work product created by Infinity Accountants, including financial reports, analysis, templates, and processes, remains our intellectual property until full payment is received. Upon receipt of full payment, you are granted a non-exclusive licence to use the work product for your own purposes.

Our website content, branding, and materials are protected by copyright and may not be reproduced without our express written permission.

Either party may terminate the engagement with 30 days' written notice. Upon termination:

• You must pay all outstanding fees for work completed up to the termination date. • We will provide you with copies of your records and documents upon receipt of all outstanding payments. • Termination does not affect obligations that arose prior to termination.

We reserve the right to terminate immediately if you breach these terms or if continuing the engagement would breach our professional obligations.

In the event of a dispute, we encourage you to contact us first to attempt resolution. If a dispute cannot be resolved directly, the parties agree to mediation before commencing legal proceedings.

These terms are governed by the laws of New South Wales, Australia, and both parties submit to the exclusive jurisdiction of the courts of New South Wales.

We may update these Terms of Service from time to time. Updated terms will be posted on our website. Your continued use of our services after any changes constitutes your acceptance of the updated terms. We will notify you of material changes by email or in writing.
